T H E   C O N T R A C T

Every order placed with Paper Soul Design (“we, our or us”) is subject to the terms and conditions laid out here at the time you place that order. We reserve the right to change and amend these terms and conditions at any time. Changes will come into effect when posted on www.papersouldesign.co.uk (“the website”). You should read the terms and conditions whenever you use the website, and your continued use of the website signifies that you accept them. If there is anything you do not understand please contact us before you place an order. The applicable terms and conditions will be those posted on the website at the time your order is placed. Any amendments to these terms and conditions must be agreed in writing.

 

By ordering from this website you are entering into a binding contract with Paper Soul Design and indicating that you agree our terms and conditions.

 

D E P O S I T S   &   P A Y M E N T

Payment for personalised stationery available on www.papersouldesign.co.uk is made in full at the time of order. For bespoke stationery payment of the non-refundable design fee must be made by electronic bank transfer before your order is confirmed and we can begin working on your stationery. You will be invoiced for the remaining balance on your order when you have signed off all artwork and your stationery is ready to go to print. We will not print your stationery if this second payment is not made. Where on the day stationery forms part of your order, payment for the these items can be differed until printing is required i.e. nearer to the date of the wedding. 

 

A V A I L A B I L I T Y   &   P R I C E S

There is no VAT to pay on Paper Soul Design products and services. From time to time pricing may be adjusted but the website will always carry the most up-to-date price. We will do our best to make clear on the website where there is a problem with availability.

 

D E A D L I N E S,   S H I P P I N G   &   D E L I V E R Y   E S T I M A T E S

We will always give you an estimated time-scale for design and production of your stationery but this will always be an estimate. Whilst we always do our best to meet deadlines there are rare occasions where circumstances beyond our control may prevent this and so deadlines cannot be guaranteed. We will always keep you informed if there is a problem. In the case of both UK and international shipping, Paper Soul Design cannot be held responsible for delays caused by the carrier.

 

UK Mainland shipping is free. International shipping (including the Channel Islands) is not included and a standard postage charge of £20 will be added at the checkout. All items will be shipped via recorded delivery and a signature will be required upon receipt of your order. Any customs fees or import tax incurred during shipping are your responsibility and must be paid by you. Paper Soul Design is not responsible for delays caused by customs.

O W N E R S H I P,   C O P Y R I G H T   &   I N T E L L E C T U A L   P R O P E R T Y

Once you have paid for your stationery in full you will become the owner of any products physically produced (whether personalised or bespoke) but you will not own the actual artwork created in the design process. Ownership and copyright of this artwork will always belong to Paper Soul Design. Once the products have been delivered to you please take good care of them as Paper Soul Design will not be liable for any loss or damage.

 

Unless expressly agreed by us in writing, Paper Soul Design remains the owner of all copyright and other intellectual property rights relating to the artwork and designs produced and delivered to you. You must not reproduce, share or otherwise use designs created for you for any other purpose than outlined in your initial order. If you are interested in obtaining the rights to any of our work please contact us.

 

Paper Soul Design reserves the right to use bespoke designs created for individual clients as part of our personalised range in the future as advertised on the website. Personal details would be altered and no reference would be made to you (the customer) unless agreed in writing.

 

R E F U N D S ,   C A N C E L L A T I O N S   O R   R E T U R N S

As the majority of Paper Soul Design products are bespoke, personalised and/or made to order they cannot be returned. If a product arrives which is damaged or faulty please contact us within 10 days of receiving it and we will discuss how best to put the situation right.

 

L I M I T A T I O N   O F   L I A B I L I T Y

Please note we can accept no liability for damaged or faulty goods if you do not notify us of the problem within 10 days of receipt.

 

We cannot be held responsible for any damages, loss or costs whether direct or indirect, no matter how they occur (including loss of business or damage to business relationships) and whether based on contract or tort resulting from any of the following: inaccuracies or errors of content on the website; transmission of viruses, bugs, or similar, which may be spread to or through the website by a third party; the unauthorised access to or use of our system and/or any and all personal data stored on it; and any down time on our website.

 

T H I R D   P A R T I E S

According to the Contracts (Rights of Third Parties) Act 1999 this contract does not give any person who is not a party to it any right to enforce its terms.

 

I N V A L I D I T Y   &   J U R I S D I C T I O N

In the event that any part of these terms and conditions is deemed unenforceable (including any clause in which we exclude our liability to you) this will not affect the enforceability of any other part of these terms.

 

This contract is governed by British law and is subject only to the jurisdiction of the British courts.

T E R M I N O L O G Y

The term “Personalised” Stationery relates to all ranges which are currently available on www.papersouldesign.co.uk at the time of your enquiry. Amendments that can be made to these stock designs include but are not limited to the following: names, dates, venues and colours. This applies to all ranges unless noted otherwise on the website page showing the specific design.

 

S U P P L Y I N G   T E X T

You must supply the text for your stationery and are responsible for ensuring all the details, spelling and grammar are correct. Personalisation cannot begin before you have supplied us with your required text. You will have the opportunity to make two rounds of amendments free of charge during the personalisation process. All changes to the design must be made before the design goes to print, no further amendments can be made after this point. If further personalisation rounds are required we reserve the right to charge £30 per hour for this service.

 

P R O O F S

Electronic proofs are included as part of the agreed price and will be sent by email unless otherwise agreed. Hard copy proofs are available at an additional cost of £25 per proof. The personalised design process includes two rounds of amendments and two electronic proofs. You will be required to check these proofs carefully and make us aware of any amendments that are required. Once the final proof has been signed off and the artwork has been sent to print no further amendments can be made. You are responsible for ensuring that all details included within any stationery are correct before going to print.

 

Paper Soul Design is not responsible for the cost of reprinting if errors (such as spelling mistakes) are discovered after any design has gone to print.

 

C U S T O M I S E D   C O L O U R S

We are happy to customise the colours in our personalised designs to fit with your colour scheme. However, you must be aware that colours can vary between computer screens when viewing digital proofs. It is your responsibility to request printed proofs at a cost of £25 per proof if you wish to check how colours will appear in print. We do not hold responsibility for custom colours which you deem to be different in print to digital proofs.

 

D E L A Y S

We are not responsible for any delays caused by your failure to check and sign off proofs or supply details within a reasonable time frame agreed between us. We are not responsible for any fees incurred by delays caused by your failure to respond on time.

 

C A N C E L L A T I O N S

If you wish to cancel your order during the design process and before the artwork has gone to print you will be entitled to a 50% refund for your order. Once your order is sent to print the sale becomes final. All sales of personalised stationery are final except where a product is found to be damaged or faulty. If this is the case you must notify us with 10 days of the receipt of the products. See above for more details.

 

 

 

T E R M S   R E L A T I N G   T O   F U L L Y   B E S P O K E   S T A T I O N E R Y

 

D E S I G N   S E R V I C E

Paper Soul Design offer a fully bespoke stationery design service for a one-off fee. Fees are calculated on an individual basis dependent on the level of work required. Included in this fee we will discuss directly with you the theme, style and range of stationery you require for your wedding. The bespoke design service includes design of products as agreed with the client in the initial design consultation, three rounds of amendments and digital proofs. See below for further details. 

 

Payment of the non-refundable design fee for all items required must be made by electronic bank transfer before your design is initiated and we can begin working on your bespoke stationery. When the design work is complete and you agree to purchase products from us you will be sent a further invoice outlining the full cost of the order via email. Once payment is received your order will be sent to print and no further amends can be made beyond this point. By making payment you are entering into a binding contract with Paper Soul Design and indicating that you agree our terms and conditions.
